We can describe mobbing
as a situation in which a person or group of people systematically use
extreme psychological violence, during a prolonged period of time against
another person or people in their workplace. Such violence is aimed
at destroying their victim´s communication network, undermine their
work performance and ultimately get their victim/s to resign.
What to do?
Request the end of your work
relationship as per article 50 of the Estatuto de los Trabajadores,
on the grounds of your company boss´ neglecting their legal obligations.
Report the facts to the Inspección
de Trabajo y Seguridad Social.
Claim damages to your company,
provided the harassment has occurred at work and falls under their responsibility.
The employee is entitled to
undertake legal actions against their attacker on the grounds of coercion
or threat, whether it be the director themselves, their representative
or a work colleague.
